Photos delivered by The Staging Studio are digitally altered representations of the actual property. They do not depict furniture, décor, or finishes that physically exist on site. Disclosing this clearly is your legal and ethical responsibility as the listing agent.
1. Why disclosure matters
- NAR Code of Ethics, Article 12 requires REALTORS® to be honest and truthful in real estate communications and to present a true picture in their advertising.
- Most MLS rules (including BeachesMLS, Naples Area Board of REALTORS® MLS, and Stellar MLS in Florida) require enhanced photos to be labeled.
- Florida Statutes Chapter 475 prohibits misleading advertising by real estate licensees.
2. Recommended disclosure language
Add the following to your MLS photo caption and listing description:
"Photo has been virtually staged. Furniture and décor shown are digital renderings and do not convey with the property."
For unstaged / decluttered photos:
"Photo has been digitally edited to remove furniture and personal items. Property is sold in its current condition."
3. Where to put the disclosure
- In the photo caption / description field of every staged image in MLS.
- In the public remarks of the listing.
- On any third-party syndication (Zillow, Realtor.com, Redfin, brokerage site).
- On printed marketing (flyers, brochures, postcards) using the same image.
4. What we do not alter
We add or remove furniture and décor only. We do not alter or conceal:
- Structural defects, water damage, or visible deferred maintenance.
- Built-in fixtures, cabinetry layout, flooring type, or wall colors (unless explicitly ordered as a paint or flooring preview, which is also covered by this disclosure).
- Views from windows.
Concealing material defects with a virtually staged image may constitute fraud or a violation of the seller's disclosure obligations under Florida law. Do not order a stage to hide a problem.
5. Your responsibilities
By using our Service, you agree to add the disclosure language above (or equivalent language compliant with your MLS) to every public-facing use of a virtually staged photo. See the Terms of Service Section 6.
