These Terms of Service ("Terms") govern your use of The Staging Studio (the "Service"), operated by Custom-Integrated, LLC d/b/a The Staging Studio ("we", "us"). By creating an account or placing an order, you agree to these Terms.
1. The Service
We provide computer-generated virtual staging, virtual unstaging ("decluttering"), and related photo enhancement for real estate listing photographs. Output is delivered as digital image files. We are not a real estate broker and do not provide real estate, legal, or appraisal advice.
2. Eligibility & account
You must be at least 18 years old. You are responsible for activity under your account and for keeping your sign-in email secure. We use passwordless magic-link authentication; anyone with access to your inbox can sign in.
3. Your content
"Customer Content" means the photographs and any other materials you upload. You represent and warrant that you own Customer Content or have all rights and permissions necessary to upload it and to authorize us to process it as described in these Terms and the Privacy Policy.
4. Intellectual property rights
4.1 Customer Content & Outputs
You retain all right, title, and interest in your Customer Content. As between you and us, you also own the staged or unstaged images we deliver to you (the "Outputs"), subject to any third-party rights in elements depicted in the original photo (architecture, artwork, etc.).
4.2 License to operate the Service
You grant us a worldwide, royalty-free license to host, copy, transmit, display, and process Customer Content and Outputs solely as needed to provide, maintain, secure, and improve the Service for you.
4.3 Marketing license (opt-out)
Unless you opt out, you grant us a non-exclusive, royalty-free license to use anonymized before/after image pairs (with all addresses, identifying signage, watermarks, and metadata removed) for marketing and demonstration of the Service. You may opt out at any time at Settings → Marketing usage; the opt-out takes effect for all future use within seven (7) days, and we will remove existing marketing uses within thirty (30) days on written request.
4.4 Our IP
All rights in the Service itself, including the website, software, models, prompts, and brand assets, remain ours or our licensors'. No rights are granted except as expressly stated.
5. Acceptable use
You agree not to upload Customer Content that:
- infringes any third party's intellectual property or privacy rights;
- depicts a property you have no authorization to market or modify;
- contains nudity, minors in unsafe contexts, or illegal content;
- is intended to deceive, defraud, or misrepresent a property's condition.
6. Disclosure obligations
Virtually staged photos must be disclosed in MLS listings and marketing materials. See our Virtual Staging Disclosure. You are solely responsible for compliance with MLS rules, NAR Code of Ethics Article 12, and any state real-estate advertising regulations.
7. Pricing & payment
Prices are shown at checkout in U.S. dollars. Payment is processed by Stripe; we do not store full card numbers. Orders are processed only after successful payment.
8. Refunds & revisions
See our Refund Policy for the full terms. In summary: unlimited free revisions for 14 days post delivery; no refund once photos are delivered; full refund if we fail to complete an order for technical reasons on our end.
9. Disclaimer of warranties
The Service is provided "as is" and "as available". We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
10. Limitation of liability
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or related to the Service is limited to the greater of $100 or the amount you paid us in the 12 months before the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost listings.
11. Indemnification
You will indemnify and hold us harmless from any claim arising out of (a) your Customer Content, (b) your violation of these Terms, or (c) your use of an Output in marketing without proper disclosure.
12. Termination
You may close your account at any time at Settings. We may suspend or terminate access for breach of these Terms. Sections 3, 4, 5, 9, 10, 11, and 13 survive termination.
13. Governing law & disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. Any dispute will be resolved exclusively in the state or federal courts located in Collier County, Florida.
14. Changes
We may update these Terms; material changes will be announced by email or in-app. Continued use after the effective date constitutes acceptance.
